This site is about my experiences resulting from a false arrest and use of excessive force resulting in a broken wrist and severe bruising by Derrick Dutton who was assisted by Georgetown officer Neil Crawford on December 6, 2002. I was arrested and charged with 1.) Failure to I.D. (I did not do) 2.) Resisting arrest (I did not resist, but was physically unable to bend my arm or knees the way they were forced) 3.) Assault (with water from a garden hose that supposedly splashed over my 6 foot high wood slat fence).

I have included a copy of the actions taken by Williamson County Texas after I was arrested and held with no medical treatment for my arm broken or any accommodations for my disabilities. Williamson County extended the case for as long as possible while they constantly tried to make me take a plea bargain.

In 2004, my husband was transferred to California. Michael Price, the lawyer I had hired to represent me for the case, told me on the day before we were moving that he would no longer represent me unless I took the plea bargain. I still refused because everything Dutton reported was a lie, and he had changed his story numerous times. Williamson County promoted Dutton to a Sergeant who trains new recruits during the delay of my trials.

Finally after our move to California, I was granted a pre-trial. I flew back to Texas from California for the pre-trial. I have included the Williamson County two year long court action list during the wait for a pre-trial. All charges were dropped following the pre-trial March 6 2004. However, the record was not expunged despite repeated requests to my attorney Mr. Steve Duskie.

After the pre-trial and dismissal of charges I filed a lawsuit against Williamson County The infamous Judge Ken Anderson dismissed the charges against the county and Neil Crawford the Georgetown officer that assisted. Dutton admits that he arrested me illegally in the pre-trial, so Judge Anderson could not dismiss Dutton from the lawsuit.

I sued Derrick Dutton. Williamson County covered all of Dutton’s legal expenses of more than $100,000, and successfully delayed a trial until March 2010. Derrick Dutton and Neil Crawford committed perjury at the civil trial, and Mr. Steve Duskie refused to present evidence proving the perjury. All medical evidence was suppressed by Judge Ken Anderson, J. Lee Jarrard and Mr. Steve Duskie at the civil trial.

The only evidence presented to the jury by Mr. Duskie were pictures of the bruising on my arms and legs by Derrick Dutton. All of my medical records were suppressed . The purpose of Mr. Steve Duskie’s settlement request of $250,000 and suppression of evidence was an attempt to cause all court costs to be mine by the Loser Pays Bill.

The plan to derail the case back fired because thankfully I was awarded no damages. I hope for the citizens of Williamson County that Derrick Dutton is required to to pay all legal costs back to the county tax payers.
